Terms of Use

These Terms of Use cover the SayItOut app for iOS, including its in-app purchases, subscriptions, features, and content. They don't cover third-party services you use alongside it, such as the Apple App Store, iCloud, or Superwall.

The app

SayItOut records what you say, transcribes it on your device, and turns it into a take you can edit. It's a personal thinking tool. On-device models do the transcribing and the structuring, so the app can mishear you, drop something, or arrange your words in a way you didn't mean. Check anything that matters before you rely on it.

License

SayItOut is licensed to you, not sold. Subject to these terms, Hmujo LLC grants you a personal, nontransferable license to use SayItOut on devices you own or control, as permitted by the App Store usage rules. You may not copy, distribute, sublicense, rent, lease, sell, modify, create derivative works from, reverse engineer, decompile, disassemble, or try to extract the source code of SayItOut, except where the law says that restriction doesn't hold. If you sell or hand on a device with SayItOut installed, remove the app from it first.

Subscription

The app itself is free and keeps one take at a time. Everything beyond that one slot is Pro, an auto-renewing subscription sold through the App Store and billed weekly at $3.99 or annually at $69.99. Prices are in US dollars and vary by region; the price you'll actually pay is shown before you confirm. Payment is charged to your Apple Account when you confirm the purchase. A subscription renews automatically unless you cancel at least 24 hours before the current period ends, and your Apple Account may be charged for the renewal within the 24 hours before that. Manage or cancel it any time in your App Store account settings. Cancelling stops future renewals; it doesn't refund the period you're in unless Apple's policy or the law says otherwise.

Free trial

New subscribers may be offered a 7-day free trial. The trial length, the price after it, and the renewal terms are shown before you buy, and they can vary by region and by offer. A trial turns into a paid subscription unless you cancel before it ends. If you buy a subscription during a trial, whatever is left of the trial may be forfeited.

Your data

Everything you record and write in SayItOut stays on your device. We have no servers and no way to read it. If you turn on iCloud backup, your takes are mirrored to your own iCloud, which is Apple's service and governed by Apple's terms. Our Privacy Policy spells out the whole picture.

Third-party services

SayItOut works with third-party services including the Apple App Store, iCloud, and Superwall, which runs the paywall and tells the app whether your subscription is active. Those services have their own terms and privacy policies, may not be available everywhere, and can change or stop at any time. You use them at your own risk and you're responsible for anything you export, back up, or share through them.

Acceptable use

You must be at least 16 to use SayItOut. Don't use it for anything unlawful, anything that could harm someone else, anything that infringes another person's rights, or anything that breaks the terms of a third-party service you're using with the app.

Termination

Your license ends automatically if you break these terms. When it ends, stop using the app and delete every copy from your devices.

Disclaimer of warranties

SayItOut is provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied, or statutory. To the fullest extent the law permits, Hmujo LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We don't promise the app will be error-free, uninterrupted, or secure, or that anything it produces is accurate or complete.

Limitation of liability

To the fullest extent the law permits, Hmujo LLC and its developers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, personal injury, or other damages arising from your use of the app or your inability to use it. Some places don't allow certain limits on liability, so parts of this may not apply to you.

Apple

SayItOut is licensed, not sold, for use on devices you own or control, subject to these terms and the App Store usage rules. Apple Inc. is not a party to these terms and is not responsible for the app or its content. Hmujo LLC provides any maintenance or support for SayItOut; Apple has no obligation to.

To the fullest extent the law permits, Apple has no warranty obligation for SayItOut. Any claim relating to the app, including product liability, legal or regulatory compliance, consumer protection, or intellectual property infringement, is the responsibility of Hmujo LLC and not Apple. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You may not use, export, or re-export SayItOut except as authorized by United States law and the law of the place you got the app. You confirm you're not in a country subject to a US government embargo or designated by the US government as a "terrorist supporting" country, and that you're not on any US government list of prohibited or restricted parties, including the Treasury Department's Specially Designated Nationals List or the Commerce Department's Denied Persons List or Entity List. You also agree not to use SayItOut for any purpose US law prohibits. Where these terms conflict with Apple's usage rules, Apple's rules win.

US government users

SayItOut and its documentation are "Commercial Items" as that term is defined at 48 C.F.R. 2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation". US government end users get only the rights granted to everyone else under these terms.

Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.

Changes

We may update these terms. Carrying on with the app after a new version is posted means you accept it.
